Ebay nonsense

Don"t ever believe the Ebay nonsense that bidding on an item is a legal and binding contract. That is just pure BULLONY. After trying unsuccessfully through Ebay to collect on several nonpaying bidders I contacted an attorney that specializes in interstate commerce. Here is what I learned. Ebay is not only a paper lion but toothless as well and here is the short version as to why.
As long as Ebay knowingly allows sellers to sell an item locally and remove that item from auction before the end of the aution there is never a true "meeting of the minds" between seller and bidders which is required in any true contract. I no longer waste my time bidding with a seller that threatens legal action for nonpaying bidders. If you are selling on Ebay just accept the fact that there are morans out there and sell to the next highest bidder and move on.

I prefer to buy from a guy who packs alot of parts into his pickup and brings tthem to a swap meet.Ebay is kind of hurting swap meets.I have only gotten junk off ebay and no dishonesty was involved by the seller. Its just that his description and mine were vastly diferent opinions. No offense to the honest guys that sell.Just like to hold the part in my hand before parting with my cash.

The idea of ebay is a good one. But like everything else in this world, it"s only as good as the people who use it. The last thing I bought on ebay, the seller included," this item is NOT for sale locally and WILL be sold to the hightest bidder." I wrote him a public note thanking him for that.

I have found in dealing with ebay that it is best to always be honest no matter what the other seller/buyer is doing. This has worked good for me and I have had very few problems throughout the past year. I have found that if I sell an item, to ship it right away and keep the customer informed always. I find most of the time others do not conform to this standard but at least I can lead by example.

This is the way I see it you dont have to be like the other guys. Read the buyer and seller policy and buy and sell the way they tell you to. I always leave feed back when an item is paid for or recieved . I dont wait for theres to see if I should they paid I leave it if your honest it should work out. I have had people that I have waited over a week for to hear from they usally delever. I get mad my self when they dont respond I think ebay should make every one read and intial every paragraph in the buyer and seller policy instead of going to the bottom and clicking the yes spot.Yes they would have to put some funny pics there to make it interesting and shorter Then if after three strikes of not folowing the three day rule and othes you get kicked off Simple. But You just have to go with the flow like cowman said I have never done this local sell thing wish I had probly lol.My wife bought me a seller help tape from a infomertial and it said when you put a reserve price on an item put the price in the listing so they dont have to guess and they said it works great. I know my self I will bid here or there just to see if I hit the reserve. I dont know I guess If you see somthing you like you bid if you get it good if you dont there will be 100 more like it in the coming year. You can usally tell good sellers buy there feed back. JON

I bid on a oil guage Tues and won.Haven't heard from seller yet.I thought the seller emailed you and gave date on when it would be shipped to you.

Don't be gettin' your knickers in a twist just yet. Some sellers simply mail the item to you without a word...

Yeah, yeah, yeah, I'm sure most of you are all huffy and indignant at this point, "Well harumph! I would NEVER do business like that!" Well, that's life... If you get the part in a reasonable amount of time, does it really matter whether you made friends with them or not?

And the ones that tick me off the most are the ones who dont leave feedback. I like you paid for an auction within a couple of minutes of the auction ending. When my part arrived left positive feedback and meqant everyword of it,2 months later, still no feedback from him/her, and they havent left any for others that have won auctiuons after me.I will no longer leave feedback until its left for me.

now john, "two wrongs don't make a right" I figure I only receive feedback for about half the items I sell. And the only ones I fail to leave feedback for are the ones that never pay and the page expires.
