CNKS: I can't get the article to open, however I take from discussion this was a case of a truck rear ending a tractor. Right or wrong?

Did the tractor have a current up-to-date SMV sign? In most states, that is key.

It did -- accident was obviously the truck drivers fault. The lawyer is just trying to get his ducks lined up -- I think he picked a good place to do that.

In the state of MD and I'm sure it's in other states that if you rearend somone you didn't have your vehicle under control. The driver of of that truck should've seen that tractor a long distance before impact. That lawyer needs to get an accident reconstuction expert. Hal

Read some of the messages over there and the lawyer handling the case for the farmer's estate did not know what a SMV sign stood for. Go figure.

Jerry: Those courtroom lawyers may not know what a SMV sign means, but they dang sure know what a $ sign means! They fight like dogs and cats in the courtroom. Then, as soon as the trial is over, they go out and have a drink together and talk about playing golf next Saturday.

I ain't had much school housin an all but. If a 706 in road the TA should be forward thus direct drive. Given the speed of the truck there should have been skid marks on the gravel or grass or pavment. This should show where the tractor was on impact, and the angle the tractor was to the pavment.

I would also assume the tread on the tractor front and rear wheels should show a little flaking or scuffing of the rubber and give a little insight to the angle of the hit.

All these factors can be overlooked by the patrolman and the correct information overlooked. I'm not so sure that what the guy is looking for has anything to do with the case. Yet you know that this will be explained to a judge that has no idea of anything other than court procedure.

I once testified to a judge that the size of a manure pit was ten ft wide, sixteen ft long and approx one foot high on one side and flat floor on the other. It was indeed a gathering point in a cow yard to get a spreader full, and to cornner the manure in. So if you think right is right in a court room you got another think a coming. The judge said NOW THAT IS A BIG MANURE PIT!

I"m on the road on a tractor a lot, and the stupid stuff people will do to avoid slowing down is ridiculous. I wind up looking behind more than I look ahead. This was certainly a tragic accident that could have easily been avoided.
