Here are the facts - make your own decision as to whether you want to do business with Warren Nyerges Jr.

A Bobcat skid steer loader A220 serial number 519611033 was sold by Warren on ebay in around September 2008 to Larry Henk of Harrisburg, IL.

Larry said this about Warren Nyerges Jr.:

"He bought it from a man in Alabama who said he bought it from a man in Ohio who said he bought it at an auction (but has no proof). The original owner had it stolen from him in 2002 when it only had 30 hours on it. It has been hidden away for the past 6 years." "When I got it I could tell that it had been repainted and had way more hours than 181 that was shown on the hour meter. I called bobcat and they gave me the name of the original owner so I called him up. He told me that it was stolen. I contacted the Hover police in Alabama and they confirmed it. They confiscated it from me and now I’m trying to get paid by eBay under their buyer protection plan. It has been 4 months and I haven’t seen 1 cent."

Warren Nyerges Jr. is no longer a registered user on ebay under his company name 'nyerges-equipment' but he is still selling equipment.

His current telephone numbers are 440-227-8947 and 440-227-6947.

Do you dispute the fact that you sold a Bobcat skid steer loader A220 serial number 519611033 on ebay under your ebay account 'nyerges-equipment' in around September 2008 to Larry Henk of Harrisburg, IL?

Do you dispute the fact that you repainted it?

Do you dispute the fact that Larry called Bobcat and they gave him the name of the original owner so he called him up?

Do you dispute the fact that the original owner said it was stolen?

Do you dispute the fact that Larry contacted the Hover police in Alabama and they confirmed that was the case and confiscated the Bobcat from him?

Do you dispute the fact that you are no longer a registered seller on ebay under the name ' 'nyerges-equipment' ?

Why would you call the police,you just hurt yourself.Ebay is not responsible for you buying a stolen item.

Once he found out it was stolen he HAD to turn it in, otherwise he could be charged with Possession of stolen property.

He already broke the law when he bought a stolen skid loader and had possession of stolen property,even if he didn't know.Reporting it doesn't always put you in the clear.The way prosecutors operate with zero tollerance you still could be on the way to jail.

Ray, that"s not entirely true. Knowledge in an element of the offnse for possession of stolen property. See paragraph 4 below, from the Illinois Compiled statutes, 2008 edition.

(720 ILCS 5/Art. 16 heading) ARTICLE 16. THEFT AND RELATED OFFENSES (720 ILCS 5/16‑1) (from Ch. 38, par. 16‑1) Sec. 16‑1. Theft. (a) A person commits theft when he knowingly: (1) Obtains or exerts unauthorized control over property of the owner; or (2) Obtains by deception control over property of the owner; or (3) Obtains by threat control over property of the owner; or (4) Obtains control over stolen property knowing the property to have been stolen or under such circumstances as would reasonably induce him to believe that the property was stolen;
