My dad made an agreement to buy a kohler lawnmower engine from a guy that had it listed in the classifieds on this site. We talked to him on the phone and got a good decription and he set a price. We e-mailed him after talking saying we would take it at the set price and he returned a e-mail agreeing to it and let use know shipping cost. We sent off a US postal money order the next day. that was mid May, we waited and when we try to contact him its one excuse after anther and has told us twice that it was shipped but as of july 3 we had not recieved it. What can we do to try to either get this motor or our money back?

I am a police officer and this type of thing is called larceny by trick. When a person advertises an item for sale and then collects money and does not ship, this is considered tricking the buyer. Depending on the amount of money is could be a felony. This can be prosecuted because you know who he is and where he lives. Advise him that you will contact the police if he does not give you your money back. Give him a date to give you your money and when he does not send it contact your local police and see if they will contact someone in his area. Depending on your state you might be able to prosecute him in your own home town. I have successfully prosecuted several people for this. Good luck

I have the same problem- I bought a hydralic pump from a man and he bad mouthed me in this discussion board (about 3 pages back you can see who it was there) I sent him his money plus a 20 dollar tip. This started in Feb, he cashed the check, said it was in the mail, that was March, Then he e-mailed me that he had broken both legs and that the pump would be sent out that day. That was 2 months ago- I sent a letter to him requesting an explanation to no avail. I'll send a certified letter next and then the fraud route with his local police. I hate to do it but I can't get any communication from him. If he would talk to me, and is in financial trouble I could forgive this debt- But I get nothing at all.

Tell them you are going to file a claim of MAIL FRAUD. And then DO it.

Your postmaster can give you the details on how to file with the Postal Inspection service, and I believe there is even a link to forms somewhere one the USPS web site. Probably nothing will come of it from Postal Inspection, if this is an isolated incident, but letting the seller know you are reporting them may shake them up a bit.

If, for some reason the Postal MO was lost, or has never been cashed, you can get a refund. Ask your PM about that, also.

Within the last year an ebay seller I had sent a MO to disappeared, and I had the local PM file a form on the MO. It took a couple of months, but I got a full refund from the Postal Service in the form of another MO made out to me, as it had never been cashed.

Never did find out what happened, or hear from the seller, but I did get my money back.

Hi Paul. It could be a case of a good person procastinating. They probably shouldn't be selling products if that is the case. Or, there could have actually been a mail problem or delay. It sounds like a very heavy item. Were you able to get a tracking number?

If it were me, I would give it a bit more time and chalk it all up to experience. Keep trying to contact the seller and get this resolved. Ultimately that would be the best option.

If you never receive the product after a reasonable length of time plus a bit more time, I can tell you what has been very successful for some others: Contact the local sherrif in the town of the seller and report a possible fraudulant sale. Many times the local sherrif will contact the seller personally to resolve the issue. As a courtesy, you may want to inform the seller that you will need to regretfully take this action if you do not receive the product within the week.

Not advice, just relating experiences of others. Please make your own decision based on your unique situation.
