YT Forum Fellas: Just got hit with a state tax bill that my friendly accountant (!!!) should have been filing for me but apparently did not. According to the tax records, I failed to fail my state taxes for 96,97,98 & 99. (even though he was paid for this)

My accountant moved out of state over a year ago and now I found out that I owe a sizable amount of taxes. I got one warning in February and BAM! they are already garnishing my paycheck and have seized some bank assets. I am trying to ascertain the location of my records and such now but I feel that I may lose my ability to pay these debts off quick enough and keep supporting my "hobby" adventures.

I guess it shocks me most since this was so unexpected & economically damaging. I have already sold my fishing boat & jet boat and a load of networking equipment that I have been collecting for my Cisco lab. I have also sold my other hobby equipment, RC cars/planes equipment and many precious momentos that I would have liked to be able to hold onto to. I would hate to have to sell my daughter's pony and trailer. But that might be coming up next. (argh)

Even with all of this, I have about $3500 left to pay. (how nice) This is once-in-a-lifetime request. If anyone wants to help me offset the costs of maintaining and operating tf.com for this month or next until I can get these issues resolved, I would be most grateful. Otherwise, I might have to shutdown this server and all other "backbone" connections until I can afford to maintain them.

I feel quite humbled and embarassed about having to face these issues and publically admit my problems & economical shortcomings. I have truly done all I can to help others with my services and I just hope that someone can help me out in this case. Otherwise, I may have to sell the servers etc. to offset the remaining balance. I have spoken with the lab that is hosting the servers and I received offers on the equipment already if needed. I feel so bad about bringing this issue forward but thought it was one of my last chances to be candid and let you know about the potential future of tf.com etc.

so fix the problem as god/fast as u can, then u wont ends up like the guy from the A&W commercial!

man i dont understand u, u were the one i always looked up to and had the best answers for everything. but i guess thats changed now...gbye

thanks for allowing us to use tf.com...i will certanly miss it..

Having both represented people accused a tax evasion and having assisted the gov't prosecute a tax cheat, I have some experience along these lines. 1. If the tax was paid during the various tax year, how could you owe now? Just file your returns, in most states there is no penalty if no tax is owed.
2. If you didn't pay the tax to the state during those years, how can you be surprised that you owe? 3. If you relied on an accountant to file the tax returns, you should have some reciepts for the services you paid him for, If the reciepts bear you out, that you paid him to file (not just prepare)the returns, you have a great law suit against him. 4. If you have proof that you paid him to actually file the returns, most states will forgive most or all of the penalties.
5. You didn't say whether he actually prepared the returns for those years. If he didn't what were you thinking? You have to sign the returns. Didn't you keep track of what you were signing or filing? Are we supposed to have pity on someone who conveniently forget to file for 4 years running?
6. You filed for the prior years and therefore knew the returns and possibly tax was due. The fact that you paid someone to do your job, doesn't hold zany weight with the tax people if no return was ever even prepared.
I hate taxes more than most folks, but they are a necessary evil. The law says you must file. If you filed for previous years, you know it has to be filed and paid. Sorry for your troubles, but I paid $20k last year in taxes. As much as taxes get my dander up, folks who don't pay what they owe really make me boil, because thats so much more I have to pay. Makes me almost as angry as welfare mammas and tobacco price supports. Both sucking up my tax money to drag down the standard of living in general.

Thanks for the great reply. Really appreciate the assumption of guilt and stupidity.

I pay my taxes but I trusted this accountant that I have done contract networking for his firm in the past and I had assumed that he had filed my taxes accordingly. Apparently this did not occur and subsequently I was stuck with loads of taxes, penalties etc.

People like you deserve to be flogged in public. Judges of society. Getting your dander up? To do my job? Ask yourself, oh grand payer of 20K to tax man - when was the last time you did anything for anyone else?

I ask you for your contact name and your number. I will call you personally to discuss this issue. I don't expect anything from you on these lines, as I question your honor with your anonymous, cowardly posts.

If as you say, you paid the taxes during those years, then you wouldn't owe taxes and penalties or interest. It would be a simple matter of getting the tax returns filed now. You can ressurrect a lot of information by getting copies of your federal returns from the IRS, Believe me the state already has your federal returns. The IRS gives the stuff to the states over their tax network. As to the accountant, file complaints with the staste's licensing agency if any, both in your state and in the one where he now lives. If he was a CPA, some states actually have funds which will pay damages to injured clients of crooked CPA's. (Most states have such funds to reimburse client who have been ripped off by lawyers.)
If payments were made to the state, the state can give you a transcript of the payment amounts and dates recieved. If indeed the taxes were paid during those years, it is an easy problem to fix and there should be no penalties and interest.
The next problem you would have is getting the state to back off on their collections. File the returns showing the taxes were paid (as you said) and then you will recieve all the current monies seized and garnished as a refund. It would certainly be easier to get the returns filed, than sell things and have assets seized and pay garnished. Besides, you are going to get all that money back, IF, as you say, the taxes were paid during those years. I fail to see why you need financial help under the circumstances.

Andy, I am sorry to hear about your problem. If you email me your snail mail address, I will do what I can for you.

On the cheap advice end. I would suggest, if you haven't already done so, contact or have your new accountant contact the state and work out a payment plan. States are generally more difficult to work with, however.

PS: I never have used your services, but I hope you can keep it going. I'm helping out because I consider everyone to be friends on this site and friends help friends.
