Had a guy drive in on the back side of my place last night. I wouldn't have known if he hadn't been playing C+W music. Told him to leave and he started to cuse me out and when I said I have your leinse number and was calling the law he picked up a rock the size of my fist and trew it at me. So how do you stop people like that?? He even had to cross some one elses land to get to my land.

First and foremost, report the incident to the local authorities. Secondly, educate yourself on the laws concerning trespassing in your state. Use extreme caution if you ever decide to confront anyone trespassing your property. Photos, times and dates, and also vehicle and personal descriptions may aid in your plight. If trespassing continues with no help from local authorities take the next legal step and contact the states attorneys office. Do not discount the help of your neighbors and local political dignitaries. Unfortunately taking things into your own hands using force may reward you with more trouble than you anticipated. You dodged a rock already, maybe you should stay a safe distance next time and call for assistance. Shooting some idiot for trespassing is pretty hard to swallow. Shooting someone to protect the life of another or yourself under legitimate circumstances is completey different. I'm certain it is a tough dilema however if you put your thinker to work there are better ways to handle this than pretending you are living in the 1800's and can do what you believe is right. Good luck and I hope you don't do something that you will regret.

You will be better off by reporting it and trying to take a pic of him and his truck and posting it in your local paper and around town. As far as using force, Well you gota think that since he knows he is trespassing when he crosses your property then what else would he do? Also find out where he is coming in at and drive some nails in a 2x6 and cover it up. Do this at a couple differant spots. And as far as some of the other advices that i have read. You all need to remember that everyone needs to watch what they say when they are on the net. Because it very well can be used against you at some point later in life if you where to shoot someone. If you where to shoot someone and even if it was in self defense a good atty good pull everything off your computer and use it against you. Even if you delete your screen name and everything that you have wrote it still stays on your hard drive and on this post! Anyway, I cant stand trespassers but report it, take pics and use some kinda diterant like nails. Just my 2c's

We had a bad case that made the news last year of hunters killed trying to get a nut to leave the tree stand. WI did come up with laws a couple years ago that made trespassing an offense like speeding that has really worked around here, but for it to work you have to call them in and after that the word gets around. It is everyones responsability to make sure they are on public land or have permission. Signs are not needed on cultivated land now and not many on other land. With the new laws they enjoy taking the trespassers money as much as the speeders. As population grows so does trespassing, so the state laws have to keep up. I used to have signs up only to have them tore down and people saying they didn't see them or better yet in later years they weren't spaced close enough or correct( this really makes the blood boil). Now the cops take care of it and I always give them a friendly wave as support for what they do. It just isn't worth losing your life to hassel with these jerks.

Just finished reading the other posts and they gave me an idea that would be prefectly legal. If your property is posted then by all rights he shouldn't be there, so there is no reasonable expectation you'd be looking for anyone before you did any target shooting on your own property. So instead of goning up to the car and confronting him and having to worry about getting hurt, etc why not exercise your right to target shoot on your own land? Set up a few plastic bottles, targets, or whatever inline with but just out of sight of his car, back up a piece and have a good old time.....Hey so what if your a horrible shot and you missed the bottle you were (NOT) aiming at and hit one of his tires or his radiator, or whatever. It's not your fault he was where he had no legal right to be. You were just target shooting, not intending any harm to anyone, and that's perfectly legal. It's nobodys fault your a bad shot, your just trying to get better and that's not against the law anywhere....In fact if you were in California the cops would have no troubkle at all understanding about not being able to hit the broad side of a barn...LMAO Just my .02

a friend was going to shoot a car stuck in his field oh and he was going to take him to jail for making the incinuation he would shoot... and they are neighbors and friends.. THE Police mand would not even call a wrecker... or make a report.

Wayne, shootin someones car? it might be legal, and it might not, I don't know. But what would cause a lot of sleepless nites is. Discovering little kids in the car or truck after the smoke cleared. putin something on kids that soap and water wouldn't wash off would be tuff. Tuff just thinking about it.

You can put out anything you want to threaten but if you put a bullet into anyone, they or their heirs will bankrupt you in court. They will probably win because having publicly advertised your intent, it will show that you intended bodily harm for what is little more than a misdemeanor in most states. To me it is reverse defense as well as reverse prosecution. The law is not what we think it is and we can walk around swinging big sticks so long as we don`t hit anyone with one. Just feel sorry for those people along the Mexican border that have bunches of trespassers almost nightly. 17 yrs ago I got run over trying to protect my property from three young gentlemen. Missed two months work, almost 100K hospital bills and my atty fees were over 20K to get off by the hair on my chinny chin chin. They said I scared them and that was fair enough in Washington state. CALL THE LAW FIRST and don`t put yourself in harms way unless it is to protect life. I still have some problems from getting my face hit by a spinning tire and my head bouncing around beneath the car, wheel running over my leg and both shoulders dislocated. I did what I thought was right but wonder if it was worth it?
The moral of the story is if you are going to chase cars don`t try to bite the tires ! It hurts. Ben There

I agree with Coldiron.

My brother had a sticker in the window of his truck that stated "There is nothing in this truck worth dieing for". Caught a guy breaking into it who then tried to fight him. Cops finally showed up and the guy walked away with a few bruises and my brother got hit with an assault and battery charge. He tried to fight it - Exhibit "A" was a picture of his window with that GD sticker in it.

Now if you want to drive a bunch of nails through the plywood and lay them pointy side up in a gateway, perfectly OK, can't help it if you "forgot" to pick it up. Actually an old beat up harrow laying upside down in the grass is very effective.

The last time we had trespassers at night, three stratigically placed 12 gauge high brass number sixes took care of the desire to rob and trespass. The shells some how found the rear glass and taillights of the car they were riding in and the other found the back side of some one running away. The next day it was all over town that you don't want to go out to nugent center headquarters of Wilson Farms because he'll shoot you first and ask questions later. That was Mississippi and thirty years ago. Force is the biggest deterent of all. If the thief thinks he has the upper hand he'll use it against you. My daddy always told me never keep a gun with me unless I was willing to pull the trigger because if you can't pull the trigger someone will take it away from you and use it one you. The law is in your favor; use it. I know we feel today that the criminals have more rights than we do but it's just not the case. If you raise enough sand, they will have to listen and do something.

Hi Thunder, I live in MO. Last year I went through the required course to obtain a conceled weapon permit for MO. One thing I learned that in our state they have what our instructors called the 3 P's. Person, premises,property. You can use deadly force to protect yourself,or your home "inside or out" but not your property. Shooting someone here for trespass is taking your chance with 12 of your peers. But if someone like in the post above is chucking rocks the size of softballs at you I can see where you might see that as a threat to your life. But if he is just throwing back some brews and listening to Merle Haggard then you better let the Law handle it to keep yourself out of the pokey.

a good friend of the family had a cabin in Kentucky

he drove in the lane and found guys in it.. and they started shooting ... he drew his gun and shot back.. they ran.. an when he got the law--- they took him in... ( yes he had permits and was legal)

what do you think he was after or wanting to do....is it someone you know..... defiantly put up no trespassing signs and say why on poster aalso say no excuses.... also you could lock gate and take pictures,video camera better. and talk to your best officer brfore the next time.... i tend to go crazy tell a man to leave and count one two three. but honestly we don't know what we would do till faced with it.

"No Trespassing" signs should work if applied firmly upside the head. Years ago our priest said to remember to pull the body fully inside the house when you shoot someone trying to break in. And broken glass belongs inside the wall, not to the outside.

I got so fed up with the neighbor going through my place (ignoring signs, too) that I finally put posts in front of the gate he was using.
He can still get through by walking, but driving has been stopped. Do like some of the others have said, put something there that will cause flat tires---at least, it's not lethal.
We do have laws here in Texas that will allow the use of deadly force to protect your property, but, unless I felt personally threatened, I wouldn't go that route. Frustrating as it might be, I think your best option is to call the law whenever someone trespasses, and put up some type of barrier to discourage them coming in.
Too bad some people have lost their manners over the years.....

I had three tresspassers openfire on a "hen" pheasant flying towards my car. I had shot damage from one end to the other, I was on a public highway, and still had shot embedded under the vinyl on the car top when the sheriff showed up. Unfortunately they missed the bird, that would have gotten them fined. As it was no law had been broken and all I could do was sue for the damage of the car which I did not do, as I don't have enough time to screw with it. When I got out of their prized bag for the day, very angry, the only response from the trio was "Couldn't you see we were hunting?!?!" Nothing gets the pucker factor like three twelve guages blowing fire your way.

Here in FL those actions would have had them boys locked up and all equipment confiscated. I teach Hunter Ed and every yr. lots of folks get busted for trespass that way. They shoot a deer in a field so that is tresspass. The next immediate ticket they are usually charged with is FELONY TRESSPASS in the FIRST DEGREE as most times they go to retrieve the deer with hunting tool in hand; trespass with lethal weapon and intent.

Last yr the legislature expanded this law to include deer dogs (Southern thang) with owner charged with trespass. I ain't met a dog yet that understands property boundaries. Need to go over to Tallahassee sometime because apparently those dogs do:) Sometimes a good thing gets soured by the city kitties moving out to the woods.

FL LAW
Section 3. Paragraph (f) is added to subsection (2) of section 810.09,
Florida Statutes, 1996 Supplement, to read:
810.09 Trespass on property other than structure or conveyance.�
(2)
(f) Any person who in taking or attempting to take any animal described in s. 372.001(3) or s. 372.001(4), or in killing, attempting to kill, or endangering any animal described in s. 585.01(13) knowingly propels or causes to be propelled any potentially lethal projectile over or across private land without authorization commits trespass, a felony of the third degree, punishable
as provided in s. 775.082, s. 775.083, or s. 775.084. For purposes of this paragraph, the term �potentially lethal projectile� includes any projectile launched from any firearm, bow, crossbow or similar tensile device. This section shall not apply to any governmental agent or employee acting within the scope of his or her official duties.
Section 4. This act shall take effect October 1, 1997.

Sloroll - What state are you in? In Oregon it is illegal to discharge a firearm across a roadway. These fools should have been locked up and their guns confiscated. They wouldn't be able to pass a back ground check to get new ones either (at least from a licensed FFL). I'm an NRA member but these are the types of idiots that gun regs are all about!

We have only had one person that we know of tresspass on land we have cabin on. I have 4 game cameras set up around the place to check out deer and stuff . Well,,got film delevoped and low and behold , tresspasser ! Nice pic of him , didn't have a clue he was beign photographed .Sheriff was no help, said was to hard to track him down, pfft . I had couple copies made and put on bulletin board at local store and watering hole."tresspasser " written on pic .Never have seen anyone else .

Okay, As you all know everyone here is good and don't tell lies. But sometime its something a man must do. DO NOT COMFORT THESE PEOPLE. But you tell your sherrif that last week you where down looking around on the property and saw some plastic pop bottles on the ground that smelled like anhydrous. This will send up big red flags for the sherrif that these people are making meth. You could however get in trouble for this or it could be true. You could just say something about you think meth is being used. By the way if anyone asks I was never here.

Lots'a'luck; been dealing with this all my life; don't think they can be stopped; have had barbed wire fences cut and the wires pulled back so "they" could ride their 4-wheelers; this was after I had locked all gates. When confronted, there are 3 or 4 stock answers..... 1st time I've ever been on here; I won't come back..... ....My brother-in-law/neighbor/1st cousin gave me permission..... ...I'm not hurting anything..... (and my personal favorite) I didn't know this belonged to anyone. Some of the guys below have given you advice that can get you sued, arrested or prosecuted.

Just be sure you don't wind up like the FAMOUS, CRIME PAYS case, in ALbia Iowa from ca 1971. A man used a trap gun in a vacant farmhouse to try to discourage a repeatr burglar. The trapgun shot the miscreat in the leg---and he promptly sued the man for his whole farm and WON! The judge in Albia Iowa slapped that burglar lightly on both wrists with a wet noodle, and then sicced the Monroe County Sherrif on the landowner! They held a militantly protested Sherrif Auction too! Yep, CRIME PAYS in ALBIA IOWA!

You can, of course point to the trap gun, for justification of stealing a man's farm (my choice of words here IS deliberate) but the fact remains, the BURGLAR was allowed to greatly profit from his misdead! In fact, the burglar suffered hardly at all for his commission of a CRIME!

The moral of the story is---You had better be careful! You CANNOT rely on law enforcement to protect either YOU or your rights---although THEY will sure enforce the law on you seeing as how you will likely be a whole lot easier toi catch than a trespasser who's threatening your life and property!

If you know that there is a tresspasser, call the authorities first. Sneak up on the tresspassers with a digital camera if possible, and take many pictures! If the cavalry arrives and doesn't evict them for you, or if the donut eaters are to busy to come, take the pictures to the local press and ask them to PUBLISH them, as part of your new campaign to unseat your local SHerrif in the next election!

Whatever you do, remember the Briney-Katco "Crime Pays in Albia Iowa" case and don't take any direct action yourself!

if it is fenced with wood posts get a galliger electric fence charger you don't need insulators on wood unless its raining and they will put out 8000 volts and unless you have a very bad heart it won't kill but is very unpleasant

old, We took care of a horse club lease (across the road from our old place) with a cabin that attracted the same kind of people that you just dealt with. A no trespass sign is of no concern to most of them and they will say a friend told them it was ok to go in and take a look around or some other lame excuse. The way we slowed it down was to post it with a no trespass and access by written permission of the club president only and ALL TRESPASSERS WILL BE PROSECUTED. Keep the guys license no. becasue more than likely he will be back to vandalize your property no matter how nice you were when you confronted him. You might take pictures of his tire tracks also as that helped us in one case. The rock incident may have given you the right to defend yourself with deadly force in some states but not where I live. If you hve a concealed weapon permit it might be best to keep your weapon out of sight because if it is seen they can say you pulled a gun on them without cause. Their word will suddenly make them the victim and you will be in a world of trouble yourself. Check your areas trespass laws and your legal right of confronting these people AFTER you have called the law on them. You may be fortunate the guy didn`t have his snake gun too. Strong locked gates will usually keep them out because they don`t like to walk very far. LOL Oh yeah, we even had them tear our signs down and step right over them. These methods helped us a lot but didn`t completely stop it.

In this state, as soon as he threw that rock in your direction he was committing an assault. If you got no witnesses, though, it's impossible to prove. Wouldn't hurt to file a complaint, though.

If the hour was late enough, and his music was loud enough, he mighta been disturbing the peace as well. Unfortunately, the current climate in most places is that private property rights aren't important, so trespassing is something you probably have to deal with yourself, accidentally.

Morning Mr. Old;I have no trespassing signs around my place and even one prominently hanging at my gate at the driveway.Last year some character drove right in and up to the house,blew the horn on his car to get someone to come out of the house and then proceeded to sell my wife a car load of new saddles and tack.After telling him she was'nt buying any horse supplies today he left. My wife called the sherrif and three days later they arressted the guy at his house which was pretty well stocked with saddles and tack that he had stolen from the western store in town.Call the police and report the incident so at least they know you had trouble if something should happen later on.Be very careful when confronting any trespasser and always give yourself as much of an advantage as you can!! Report it. Especially if you have his number. You might be doing a big favor in the future for someone else that has a problem with this character. Old peg tooth harrows some times get left in back roads. Some are even upside down. Never shoot any one unless you can prove you are afraid for you life.

Post it well and weld up some short (4-5 inch) spikes on a piece of channel iron wide enough to get both tires. Place these on the ground near your gates/access areas then wait.Shouldnt be long fer ya catch`em cause with 4 flats they aint going anywhere in a hurry.

Call the law BEFORE you go out to kick 'em off. No use taking anymore chances than you have to.

Unfortunately you'll probably have to post No Trespassing signs along your fenceline or property line.

Did some extensive research on this problem last year, and unfortunately, it is against the law to shoot them. About all you can do is turn them in, get pictures if possible, and they Might get slapped with criminal traspassing. Don't know if accidently backing into their radiator when leaving on your own property would work or not. Down here in Missouri, the law won't investigate a traffic accident on private property . Don't know, hard call. After the fact of course, the law won't usually give you the time of day. No one was actually dead yet, so it's not that importqant. To them. Harley

Thats the problem I'm in Missouri and consevation and the cops say they will talk to the guy but I'm not going to hold my breath.

I kinda agree with you and Harley, but I think the problem is more the judges and prosecuters than the cops. After all "penny ante" tresspasing charges don't make the front page. If our officals would put as much effort into real crimes as they are seat belt laws they just might take a bite out of crime.

friend of mine had a problem with a guy in a jeep driving in his fields he even ran down the gates so my friend welded a straight sharpened steel rod on a gate. wouldn't you know the next day he got up and found a jeep sitting in front of hte gaate with a rod straight through the grill, radiator, and started into the engine :)
