Rattlesnake killing illegal in NY

Read in the paper yesterday the NYS DEC fined a guy for killing a rattlesnake! It seems they are rare in NY and they are protected to try and bring the population back up. I think the guy deserves a medal. If I see one on my place (not likely) it's a gonner. I'll know now however not to show it off.

it is legal to kill poisonous snakes in ga.i used to kill diamondbacks by the truck load.but i guess i must be getting soft hearted cause unless they are in the yard i dont give them a second glance anymore.but..... if its in the yard its gotta die. cotton pickin thang might git in the house

timbercutter in Ohio got fined for bringing a dead timber rattler into town. Tree he felled killed the snake, he just brought it to town to show people what one looked like. He was fined for being in posession of an endangered species. They do the same if you're carrying a hawk or owl killed by a car.

It is about time we put the animal's a below humans. I had a colony of bats in my work shed, which are protected where I live. They fly, and pee in flight while circling my shop before they leave. Every thing the pee landed on there was a instant rust mark. There will be a few empty seats on the bat return flight to mexico where they live in the winter. I don't care how many bugs they catch. Mr rattle snake you better not come in to my yard eather. stan

Here in Arkansas it is illegal to kill any snake.HA HA HA HA it is an unenforcable law. We have every species of venomous snakes in North America except the coral snake. I will not kill a king snake or a black snake but if it is poisonous its dead. A game warden here would be afraid to ticket someone for killing a snake because he might find the cab of his truck full of them.

mj, Get in contact with NY DEC, Tell them to send a truck to Sweetwater, Texas in March/April of 08. At the Sweetwater Rattlesnake Roundup. We can send a Semi load back with them to replace the one that got killed. We will all be happy then. We will be minus a whole lot of snakes, and the New Yorker can live amungst the snakes.
We kill them left and right down here. No fines, We just hand out medals for killing these extension of Satin. LOL!

When I was a kid in Northern California you couldn't take a step without looking to see which kind of snake was under your foot. Rattlers didn't live long the others could make it past us if quick. Want to get rid of vermin bring in lots of Hawks owls and such. They do a good job and don't bite back.
While i was brush hogging a field I had a Peregrine Falcon sitting about 20 ft. from my cut waiting for me to pass by so he could catch what ever ran out. Walt

I kill'em all the time, got to be a den somewhere near by. In the spring when they crawl out of their den and start moving is when I kill the most. Thru the hot summer after they scatter out I don't see many here at the house, maybe two or three. I got lots of pictures of dead rattlesnakes if the law ever needs evidence to hang me here in Texas. I'll shoot every one I see, and I'll even go out of my way to do it. If I see one crawling in the on coming lane better not be anybody coming cause its mine. THE ONLY GOOD RATTLESNAKE IS A DEAD RATTLESNAKE.

I don't think we should be protecting poisonous animals. People say they control rodents, but bull snakes live in a similar environment as rattlers and they can fill in the ecological gap when the rattlers are gone.

Well I guess we'd better get out there and start killing more spiders and bees - and oh yeah, lets not forget ocean Blowfish and Jellyfish. In the Northeast, there have been many more fatalities from spider bites and bees stings - than the Timber Rattlesnake. Also many more human fatalities from Hantavirus and West Nile Virus - carried by various rodents, birds, etc. And, a heck of lot more deaths from drunk humans behind the wheel or a car or truck. In fact, more bulls on dairy farms have killed people here - than any rattlesnake ever did. We've had three such deaths here in the past two years.

New York has one recorded fatality - ever - for a Timber Rattlesnake bite. And, New York doesn't have 1/100th the rattlesnake population it did 100 years ago.

Vermont has none recorded for it's entire history.

North Carolina with it's warmer climate has two on record - for the past 150 years.

There been less than 10 recorded fatalities from Timber Rattlers for the entire United States in the past 100 years. Yet - 139 U.S. citizens have died from Hantavirus since 1993 - that we know of - which is carried by mice and a few other rodents. And, the mice population is doing fine, whereas Timber Rattlers are just about extinct in the Northeast.

Sounds like we really need to fear the snakes around here.

Back east we had black snakes in the corn cribs...ok. Mice eaters.
Here in Texas...well, you know what we have down here. Lost the daughters Beagle to a snake.
So...see snake...see dead snake.

Personally, I think the guy is an idiot. Same goes for the other DEC arrests listed along with it - including the guy that illegally baited and shot the black bear, and the guy jacking deer at night with the spot-light close to someone's
home.

I live in an area in New York that still has rattlers. They rarely hurt anything and just want to be left alone. And, if you get bit, it's rarely fatal. When I worked for the local Deeere dealer, we'd find them curled up inside Deere crawlers once in awhile - they liked to sleep by warm engines.

When I worked downstate - in Orange County, New York - my 80 year old boss was part of club of rattle snake hunters that caught bags-full of the live every weekend. They were milked of their venom to make heart medicine. Now, that is also illegal because they found out it eventually kills the snakes.

I don't have a problem with killing animals that present a danger, or for food. But - yeah, I do with people killing things just for the heck of it.

I'm agreeing with you from Allen from Neb. These Eastern folks have never run up against any thing like a "Red Mojave Rattler" or a [Lord help you if you ever get close to one] Black Tailed Rattler. Neighbor lost a good Pack Horse to a Black Tail and my Daughter has lost several Dogs and Cats to Rattlers this year. I have two resident King Snakes and they do a fine job of controlling my area but May to Oct. is a keep your eyes and ears open time of the year. Just this August I saw two rapped around each other on a Dirt road I frequent and I drove my truck wheel up alongside of them and they both avoided the wheel but when I got out of the truck they assumed the position until Mr. Glock took care of them. We had a pretty good cook out that Night and one of them ,thanks to my SIL, is now rapped around a black Resistol with a Pc. of Turquoise as his center pc. Seems your are ignoring the fact that "us Eastern folks" live in the East. The post is about a Timber Rattlesnake in New York - i.e. the Northeast, not the west, midwest, or southwest. Different area, different animal population, different problems, and different laws and reasons for them.

If I find any Mojave Rattlers out in my field or woods - I'll let you know.

I don't agree. Idiocy on the part of the guy the killed the snake, yeah.

The New York DEC isn't making any great efforts to bring back the rattlesnake numbers - they are just trying to preserve the few we have left. Since the reintroduction of the wild turkeys here - they've just about wiped out the snake population - besides doing a lot of young crop damage. Rattlers and other snakes cannot reproduce anymore since turkeys love small snakes for snacks. And, we've got way too many wild turkeys here - they're everwhere. And, on that subject - the DEc has given me permits to shoot problematic turkeys whenever I want when they cause crop damage.

I don't pretend that some of what the DEC does is dumb. It's government. That's not to say though, that some of what they do, makes sense. My nextdoor neighbor is a dairy and crop farmer along with working as a DEC wildlife technician. He's pretty good - and not exactly what you'd call a "tree hugger." He's a farmer, trapper, and hunter but still has some repect for what's out there. He and many others I've met are pretty balanced.

Hopefully, most people - at least some farmers - have an understanding how many things effect each other - including thoses natural and those man-made. We had some jerk here last year going around killing wild bees in their hives in bee-trees. And, at the same time New York has a bee shortage and many pumpkin farmers have to hire swarms of bees to get their fields pollinated.

Had another jerk shooting every possum, coon, fox, coyote, woodchuck, skunk, etc. he came across because they might have rabies. He got caught shooting a young whitetail fawn claiming they carry tuberculosis. Yeah, well so do humans. Personally, I think someone ought to shoot him. If you don't like, or you fear animals then go live in a city.

I don't pretend to know how everything - affects everything else. I also can't say what good to all else a rattle snake does. It is part of the natural system however, and does not have a record of causing harm around here. Maybe out west, things are different. I've picked many up and moved them. Here in New York, they are usually too cold to move very fast. And,when they climb on a rock to get 10 minutes of sun, some jerk freaks out and kills them. They rattle because they want to be left alone, not because they want to bite somebody.

If a person feels threatened and kills one, fine. If you've got them near your home, again - go ahead and get rid of them. But some jerk out in the woods - either panicking, or killing one just for fun and perhaps needing to brag about his great conquest - well - I think he's the idiot - not the DEC guys fining him.

I gotta agree with ya on this one. The last (and only) time I've seen a snake was in my high school ecology class. Teacher had 2 garter snakes in a tank and an albino Python( *I Think*- I can't remember exactly what it was but it was cool).

I've never seen a snake in the wild here, but I respect them for what they do. I hear about the random Garter snake that gets run through a baler and then is found in the winter while feeding hay, but that's it.

One thing I've learned, Never brag about any kind of animal you killed to the towns folk. Someone is likely to blow the whistle on you.

The guy was too honest about his actions. I would have offered that he was: 1. Acting in self-defense, 2. Protecting an innocent child, 3. Accidentally killed the snake after it startled him, 4. Offer to check into snake re-hab

It's illegal to kill rattlers in Michigan as well. Last time I saw one I was about 4 years old (50 years ago) and as I was walking over to see what it was my older brother pulled me away and likely saved my life. Our neighbor came over and killed the snake. The next day our pictures were in the local paper due to the heroic actions of my brother and the neighbor.

Sometimes it's better to seek forgiveness than ask for permission.

Thought it was illegal in Michigan, Bob. Haven't run into one for a number of years here on the farm. When I did they didn't last long. My uncle's place down the road a piece was a haven for them. When I was a kid we did a bunch of them down there. Guess it is the 3 S's now!

Would you believe in Missouri its not legal to kill any snake. To many on the endargered list here and few people can tell the difference in a black snake and a king snake etc. etc.. They do look the other way if its a copper head but a king snake thats another story
