sales tax on off road fuel

Did anybody hear that ag fuel will be taxed here in NY? I read that as of 1/08 well will be getting ulsd, and the state will charge the delivery company sales tax when they purchse oil. The company will have to send in some paper work to get there sales tax back. They said most oil companys wont bother, they will just charge it to the farmer at the time of filling our tanks. We will then have to file more paper work ourselfs to get our money back. With all this paper work and regs, its like loaning the state money, with no interest back! Seems like it will cost more money and headaches. Hire more state workers to file more garbage. Kinda getting like communisum over here.lol

Hi Jay,

Arizona has done that for years on off road fuel. AZ requires that you file a income tax return to get the refund paid on off road fuel. This way they collect state income tax at the same time.

I'm surprised that more states haven't went to this type of tax collecting as then it's on the tax payer to get the refund and not the state to track the sales.

All taxing sucks IMO!

here they have spent more than that to learn if we have some previously unkown plant or animal species. u.s. route 20 from chicago to dubque ia was to be a 4 lane road before i was out of grade school well that still hasn't happened and i got out of 8th grade in 1963.

It's been that way here for as long as I can remember...
We pay for the fuel.
WE pay Federal Excise tax.
We pay Road tax (except on exempt fuel)
We pay a Harmonized Sales Tax (HST) on the SUM of the previous three... so it's not just a tax, it's a stacked tax.

It's not really a big deal though. Any business with a business registration number is elegible to claim the tax back. We must also charge tax on most everything we do... The end result is that HST is revenue neutral to a business.... but we are loaning our money to the government for the quarter or the year, depending on how we file.
At the end of the day it's a consumption tax on the consumer, not businesses... and another bit of paperwork.

I don't remember now if it was Michigan sales tax or federal motor fuel tax that we were charged quite a few years back. Whichever it was,it didn't last long.

Jay's post said "sales tax" not road tax. We have had to file a form with the fuel company and with any other company where we buy ag related stuff that exempted us from sales tax on that ag stuff including off road diesel. I have had the fuel company fill my ofd tank and fuel oil tank in the past and they make one stop and fill both tanks from one truck. There were however two reciepts one for ofd with no SALES tax charged and one for fuel oil with sales tax charged. Some farmers have been suspected of filling their fuel oil tanks from their ofd tanks. tsk tsk tsk.

In Iowa its road tax and in the US its federal road tax. Takes keeping fuel receipts for the off road use and adding on page to the state and to the federal tax returns. Yes, its a free loan, like all the money withheld from your pay checks and that you get back in your tax return. You can complain but you won't achieve changing that free loan.

Okay, as a family farmer for years I agree with you guys that it is bull to charge fuel tax for off road fuel. However you said that the fuel company could file the appropriate paperwork and fix that before it gets to you. But they will not do it because it is to much work. It is not the DOT's problem your fuel company is lazy. Let's not place the blame in the wrong spot. Do you realize how many people inappropriately use offroad fuel. The fact that the state has to charge tax on the fuel is the result of crooked end consumers ABUSING the tax break for farmers. And by the way if this was a communist country you would be in prision right now for speaking out against the Government. Maybe you should enjoy your freedom and realize that the reason we have to have some of these laws is not beacuase of the over educated morons. It is because of the REAL LIFE MORONS who do not know how to act in a society where we are FREE!!

OK Leader 48, You have a point, but the same truck that fills my farm tank, also fills my furnance tank! Am I supposed to pay road tax on that now too, to heat my house? Im just glad I have plenty of fire wood, and the house only gets filled every other year or so. I think ULSD will be going in our furnance tanks also. If I understand it correctley refineries dident want to produce ULSD and lower sulfer diesel for off road use, so everything is to be ULSD. I dont know havent ordered fuel yet to see the color of it.

Hi Jay , All the fuel trucks around my part of the world have multiple tanks . They can carry 2 types of diesel and gasoline too depending on what's needed . They also have a cleanout tank so they can flush out the hose when changing from one type to the other . ...Randy

communisum from what I can see is pretty much a daily thing in the US. Or maybe more like Nazi germany. One of the main problems we have is we are letting other nations kinda run us around in a way. Like gas prices, I keep hearing about supply and demand, stock market and such, what it boils down too is greed! Nothing more. Oil companies raking in record profits????? come on guys, wake up and smell the oil! its pure greed, its gouging, its basically raping the poor people in this country to death. I hear talk of recession, well now theres a big surprize, people are having to spend money for gas and diesel that they would be spending for other things so the other things get left out. It don't take rocket science to see whats going on. Now some of these over educated idiots out there might disagree but there are too may people in this country nowadays that are educated beyond their intellegence. I know some people that are so educated they are basically stupid. All the book sense in the world ain't worth a hoot if you don't have common sense to go along with it. This is one of my biggest pet pieves in our society today.

yea we've been hearing that in illinois for years more money is needed for road repair no matter how much we pay most of it ends up in cook county or chicago. now the idoit governor wants free pass for senior citizens on mass transit in cook and collar counties. i don't get free gas and mrs 730 and i are both 59.

Not to mention, ATV;s, snowmobiles, chainsaws, log splitters, weed wackers, grain carts , bedding choppers, generators,,,,,ect see the big picture. We are paying billions of road tax for off highway uses, now they want tax fuel for making hay. Were is all that money going?

Where did all the money go ...Hmmm. Look out on the interstate when they are clearing snow off a bridge - it takes 4-5 trucks just sitting there doing nothing - well not nothing - they are there because safety regs require it , but all they do is sit and run the engine and the driver is collecting a pretty good sized paycheck to just sit there . All because there's drivers out there that can't seem to see a 28' long 9' high bright orange truck with a thousand flashers on it . Road crews HAVE to take extreme measures for safety and we pay for it with taxes .
