it being gear oil doesnt bother me. As you have indicated, being without a ta, gear oil is fine. When u have a TA or the tractor uses the rear end for a hydraulic res is where you get into problems. Luckily i dont have either of these. It just bothers me cause its coal black and is quite a bit low. I actually had to stick a 4 inch cable zip tie in there and it only got the last 2/4" inch coated, so It definitely needs new oil. I am going to drain it, re evaluate the "leaky" cover piece on the belly, fix that and price new gear oil. Boy I hope case has this seal or I'm screwed... No napa around here...
