I just read a true story about a guy in Arizona that was killed for his dogs barking. I made up the names as I can't remember the real names but the story was on 60min? Dateline
Bob is camping in the woods with two dogs. The camp is right off the forest service road.
Sam is hiking on a trail that appears the trail leads upto Bob's camp. Sam is packing a 10mm semi-auto pistol using factory hollow points "for protection".
As Sam gets close to the camp, the dogs hear Sam and start barking while running towards Sam. Sam fires a warning shot into the ground at the dogs so "he doesn't get bit" This puts the dogs about 50ft away from Sam still barking.
Bob here's the shot and starts running towards Sam, "screaming". Sam is telling his version and says Bob says 'I'm gonna kill you" Bob is unarmed.
Sam then turns his weapon on Bob and triple taps Bob in the chest with the 10mm as Bob said "he would kill him"
Sam looks at what he had done and try's to help Bob but see's it's a loosing battle but made Bob comfortable as he could before leaving to get help as his cell phone would not work in that area.
After 1/2hr of walking, Sam flags down a motorest and sends them for help.
Bob dies, Sam is convicted of manslaughter. It was very close is considering first degree murder but I think the judge stopped that.
Interviewing jurer's afterwards, they had a problem with Sam's
1: 10mm as that was a larger calibur than cops carry
2: Why was he using hollow points? To make sure he killed Bob?
3: Bob had crossed his arms over his chest by the time the third bullet was fired.
4: Why did it take so long for Sam to walk to get help. It was a 15min walk back too Bob from where the motorest stopped.
After watching the TV show, it was plain to see Sam did not like to meet dogs on his walks. To me Sam needed some time to really think what he did but the surprise was how the jury preceived Sam's instentions based just on the weapon and bullets he carried. I think that Sam got really lucky first degree murder was not a factor.
I thought you guys might find it intresting on the out come of firing on someone unarmed. Arizona is very liberal on there laws for self and home protection. My son also stated that's why they can't carry reloads in their service weapon, because of the jury.
