why 460 would not go without right brake pushed

My cousin and I pulled the PTO out of his 460 that he had quit going unless he stepped on the right brake and the discovery was made. The right hand bull gear was split around the axle splines. We kind of think the axle will need replaced since it has spun in the bull gears inner splines. Now it looks like he will be removing the top off the transmission.
