I've rode and also carried many riders on clam shell fender tractors, and intend to continue this practice. I believe the "do-gooders" vastly over-estimate the potential dangers for most operations. However I do believe it is safer to have the passenger leaning/gripping on a fender, coupled with most of his/her weight on their feet. With someone "perched" on a flat top fender and their legs dangling, it increases the possibility they could lose their balance and topple off.
