While you should check your local building permit office for up to date info specific to your area.......... The new federal regulation that went into effect in Jan and was enforced Nov 10,2011 has to do with tanks that can discharge into navigable waters. Storage capacity is also limited to 1320 gals but it does NOT have to be one tank. It could be two 700 gal or three 500 gal tanks.
In most states (maybe not yours) fuel tanks of 500 gals or less and heating oil tanks of 1000 gals or less are exempt from spill regulations. This does not exempt them from Haz Mat labeling regulations though.
