JCB Backhoe overheating

I have a 1990 JCB 1400-B backhoe. I have had problems with it over heating since I got it. I am told that the spaces between the raidiator fins are too close together and clog easily. I never had this problem with my John Deere. I had to have a new engine put in with only 4,000 hours on the old one and am now trying to gather evidence that the hoe came with a poorly designed raidiator and get JCB to pay for the new engine and tork converter (the shaft broke due to the slop in the crank shaft, cause by overheating of the oil). The block was cracked also. Anyone with any information. Anyone have to replace their engine, that might be interested in a class action law suit to recover their money. I have a an attorney that would consider taking it on contingency if I gather all the evidence.
