He does have a property right,the water is his. I would say that the Blm was attempting to get him to relinquish his water rights back in 93 in order to comply with their management plan,this was a common tactic. The IRS taxes ownership of grazing rights in the estate of the holder. During WWII the military need a huge area in eastern New Mexico for the White Sands Test site they paid the grazers well for their permits and water.
