Client had a business called "That Little Brake and Muffler Place." He brought in a letter he got from a lawyer in Tennessee, threatening a lawsuit for trademark infringement if he didn't "cease and desist" from using his client's identical name immediately.
I wrote back, pointing out that the legal standard is whether the similar names could cause "confusion in the marketplace." I opined that one seeking brake or muffler work in Tennessee would probably not range as far afield as Washington state, so confusion would not be likely.
I also told him my guy had been using the name since 1980. How about his guy?
