Greg as you most likely know that falls under theft. That's as good as an excuse to fire someone as there is as long as you can prove it.
As far as people threating litigation over anything you have no way of knowing what they are telling a lawyer. The lawyer has know way of knowing if the got told the truth. They really can't do much but go with what a person tells them. On the other side most workers, or at least low level ones have no idea what constitutes "wrongful dismissal".
Only thing that you can do is make sure that you have all your ducks in a row and a paper trial.
