He needs a lawyer, yesterday. Actually, he needed a good lawyer about 15-1/2 years ago...... The thing that bothers me here is that the bank 'went along' with this scheme at the time. Now mabey lightening will strike me dead today.... but around here chartered banks DO NOT go along with that kind of crap. They don't now. They didn't 15 years ago and they didn't 40 years ago. There must have been some type of enforceable agreement there to satisfy them at the time.... and everything today would depend on that. I would expect that if he built the buildings then he would simply own them no matter who owns the land. He may have to remove them, but they'd still be his. Paying the tax doesn't really mean a whole lot here. Anyone can have the tax bill mailed to them and pay it. That doesn't give them title. It might however give them an interest equal to what they can establish they paid... Again, get a lawyer...
As far as the family goes... these situations really make me angry. If this guy was staying there operating the farm, looking after the old man and spending his money keeping the place up (and no doubt he was) while the rest of the family lived their own lives elsewhere and did squat... then I don't think they have much right to come looking for anything. I'm not shy to say if someone pulled that I me... there'd be a scorched earth policy employed the likes of which is not often seen.
