Because the Sun isn't at its highest point in the sky when your clock says 12:00 (noon local time). The difference is the error of your clock compared to "Local Solar Noon".
Local Solar Noon is when the time when the Sun is highest, the time on your clock when that occurs varies by season because the Earth's poles are tilted, the orbit around the Sun isn't perfectly circular, and you need to consider both the Earth's rotation on its axis and its orbit around the Sun.
