E Verify is a joke. While it will MIGHT keep you from being fined for hiring illegals - as a screening device its failure rate is around 50%. Meaning 50% of illegals with false ID are deemed legal and eligible for work. Occasionally it also kick out a truly "legal" person as illegal.
They pad their success rate by claiming that that they are correct 90% of the time - the problem is they consider declaring a legal person "legal" as getting it right too.
The problem for an employer is the law as enforced. You have Spanish speaking person that you "suspect" is illegal - if you refuse to hire them without documented proof you can and will be sued by the individual or by the government for violating his civil rights - for discriminatory hiring practices. Because you suspect they are illegal if you conduct a more extensive background check than you do your other employees you can and will be sued for discriminatory hiring practices. If the individual passes E-Verify (part of the 50% failure rate) then you hear your employees talking about how the guy is illegal and admits it to them - you can't do anything about unless you want to be sued.
