You don't have to take the insurance company's first offer. They just throw it out there to see if they can get away with it. A drunk driver once caused an accident that totaled a Buick Century our daughter was driving. He was already on a high risk plan with a company in Indianapolis. The Buick had every option available for that car, including a factory sun roof. The Adjuster I was working with made an offer based on the lowest priced, basic model for that year, which was about half of that car's value. He wouldn't budge.
So, I looked up the value of the car in four price guides, NADA, Kelly, etc., and took an average of the four as the price I wanted for the car. I wrote a letter supporting my price and rebutting the Adjuster's price. I then went to the Nebraska Department of Insurance with my letter and filed a formal complaint against the company. By law, the company had 15 days to respond to the complaint.
I loved this. On the afternoon of the 13th day, the Adjuster called me and said they had "reason to review my claim". He then made me an offer that was almost to the dollar of what I was asking for. Plus extra for substitute transportation. In other words, the Nebraska Insurance Department told the company, "Get real or you're history in Nebraska".
The bottom line is, don't try to inflate things, but stick to your guns on a fair price and hire an attorney if you have to.
BTW, I've never understood why people refuse to hire an attorney even if it would be beneficial. People who don't hesitate to run to their doctor every time they have the sniffles won't pay a few dollars for the help of an attorney. A ten minute conversation with an attorney once saved me from making a $50,000 mistake and he didn't even bill me.
