When one wheel is raised and the other lowered it moves a bit from the radius rods cannot change length as would be require if the axle was blocked with spacers so it could not move. The more the axle raises on a side and lowers on the other the farther the axle moves. I have a 41 9N, a 44 2N bought new by Dad in May of 44, had a NAA and a Ferguson TO 30 and all are the same way. You just have to make sure there are no worn parts. The 2N we did have to replace the pivot pin as it was getting worn but that came from when we had a front loader on it and the center section of the axle was bent down. If you tighten it up so it cannot do that moving it is libable to break something else.
