Here's what happened....Hunter puts deer stand up on neighbors property without permission. As Hunter is approaching his stand to get ready to hunt, he sees Landowner taking down stand. Hunter quietly follows and watches Landowner put stand in his garage.
Hunter calls sheriff and reports stand stolen plus, he knows who took it and where it is.
Sheriff arrives and hunter points to Landowners garage as the location of his deer stand. Hunter tells sheriff he has proof deer stand is his because of identifying numbers etched on frame.
Sheriff knocks on Landowners door and asks to look in garage for Deer stand. Landowner tells Sheriff 'Yes, he has the stand in the garage' and proceeds to tell Sheriff that he had just taken it down earlier in the day, when he came across it on his property.
Sheriff says 'Based only on the 'provable' evidence that is in front of the sheriff at this time, the Landowner is in possession of stolen property and places the Landowner under arrest for theft.
It cost my neighbor boocoos of money trying to defend his case but, still got charged with theft.
Moral of the story- either leave it alone and call the Game Warden or take it down but, leave it laying there (Which is what I do).
