Where I live, there is road right of ways for so many feet from center of road. This varies for township, county, or state roadways. A land owner can be asked, or the appropriate people in charge of the right of ways. For instance, the township pretty much has the right to do what they want within the right of way. This would include keeping it free of trees. Laws on this could vary from county to county, or state to state. Just to keep things legit for yourself, I would make sure that you got permission from the land owner. You could pretty much consider having your bases covered if you do that.
I do know of a guy that asked the township where I live, if he could cut trees within right of ways. He was granted permission with the stipulation that he had to clear cut, no selective cutting. Since he had township approval, he was able to cut without land owner permission. This may not be allowed to happen in another locality due to varience in laws.
