Traditional Farmer: The only thing I know of that can make gray market equipment illegal is if they do not met emission and safety standards.
I ran into a JD self propelled forage harvester that had been originally sold in Europe and then shipped to the US. It was new enough that it would have had warranty left on it. JD refused to honor any warranty on it. It did not met the US ASAE standards according to JD. The only thing we could find different was in the controls. The header lift switch was backwards than the US models. You pushed it towards the front rather than back to lift the header. Then there were one or two of the safety switched that worked differently. This was a JD 6710 chopper so it had computer control modules. Them and the wiring harness was different. SO not much really different but enough to not met The US standards.
The reason that these choppers were getting shipped over here was the exchange rates made them $50K cheaper on the used market. JD sued enough people that the US customs would not allow them into the US after a period of time.
Right or wrong JD stated reason was since the chopper did not comply with the US safety standards that JD could be held liable it someone was hurt on the gray market machine.
The trouble we had was the chopper had a wiring fire that destroyed the harness and several of the control modules. JD would not sell the parts in the US. It was going to be an expensive repair even if new parts could have been bought. We looked into just switching it to the US sold components. Basically making it like the US sold machines. The insurance company finally just totaled the machine. JD actually bought it off the insurance company. I never could find out where they shipped it to or what they did with it.
