My shop policy is this: If a job has been estimated to cost more than $1000, I require the customer to not only sign the work order, but also sign a work contract, spelling out exact terms of what I am to do, and also stating terms like late fees, storage, collection expenses, etc. Regular customers and those I know personally sometimes get a little slack in this regard, but persons unfamiliar to me get this routine every time. If the customer gets "weak in the knees" and fails to live up to his end of the contract, after 30 days, I own his stuff. Period. I also get at least a 50% deposit to cover the cost of parts and supplies. Two years ago, a man gave me a bad check for $2000. I had his car, a '69 Buick Skylark convertible, almost done when he gave me the bad check. I took him to court, and won, but he swore he would never pay me, and never did. I applied for, and got, title to his car under an expressed mechanic's lien that he agreed to in the work contract. I took his nearly completed frame-off restored car to a car crusher and had it baled into a cube small enough to fit in my pickup, hauled it to his house and dumped it in his front yard!! He called the cops, I explained the situation, showed the paperwork, and the cops told him that there was no law against my delivering "his" car to him on his property. He has the most expensive lawn ornament in town. It costs too much money and a man has to work too hard to let some deadbeat screw up your life. Send the owner of the Case dozer a registered letter, stating that in a certain amount of time, you will start charging him for storage. When the storage charges start, send him another registered letter stating that in 30 days from the date the letter was sent, you will assume that his equipment was abandoned and that you will dispose of it in whatever way you see fit to cover your expenses. Keep all the documentation and you will win if he takes you to court. Good luck and all the best.........Greg
