A seller could do what you describe, but it serves no point. The reserve takes care of minimum value to sell. Relisting the item takes time and isn't a selling advantage. Doubly so complaining about deadbeat bidders (I've had some). As for contacting a second highest bidder because the high bidder fails to pay, that's a built in e-bay feature for sellers. Non-paying high bidders are becoming quite a problem. So much so that e-bay has built in a single button feature to allow you to contact the 2nd highest bidder. It's real and legitimate. Lots of people bid and then refuse to pay. Yes it's a legal contract. As a practical matter, it's virtually unenforceable. Trying to take legal action against someone in Texas when you live in Maine is expensive and difficult. It's just normally not worth it. There are undoubtably shills and such on e-bay, just as there are in regular auctions. If you let them bid you up beyond what you're willing to pay, shame on you. That's your fault, not theirs.
