Nope, that's not what eBay and most other major internet companies are complaining about. Besides, that scheme would do absolutely zip against spam since 99.99% of it is sent from hijacked machines so the spam senders could really give a rat's petute if it slows down someone's PC. eBay &tc are talking about how the major ISPs like Verizon, AT&T, etc want to create different levels of service so they can hold vendors hostage to premium service prices. One major driver of trucking and the Interstate Highway System was the arrogance of the railroads -- you have to ship by us, at our rates, at our schedule. Very similiar to the big Telcos today, once again. They've managed to get down to only one or two mergers left to re-consolidating AT&T and they're flexing the monopolist powers again.
