The one answer you were never given is that you don't even need small claims . If this is a repair shop liscensed with your state (better be or you owe them nothing and state will fine them heavily) then they are REQUIRED by law to give you a written estimate on ANY AND ALL repairs and get your signature on a repair order BEFORE any work is done! If they don't you do not owe anything and the state liscensing bureau will handle it without expense to you. Question to you is , did you sign a blank repair order?? Did you sign a new or revised repair order every time they decided it needed more or different repairs?? If you did you are out of luck. If you did not then take this matter to your state bureau that handles repair fascility liscensing and complaints. They are there to enforce the state laws that EVERY liscensed repair fascility MUST follow. Bottom line is , if you didn't sign a repair order you don't owe anything. Never sign a blank one and never tell them to "do whatever it needs". Also , for future reference , any unliscensed person doing repairs for the public for compensation of any kind is against the law and as such cannot legally accept compensation let alone force it. You would not legally owe this person anything and if you already paid them the state will fine them and you would get your money back. Your tax dollars are already paying this bureau's existance. Use them. Also , a little O/T but rellevant , any of you out there that have ever purchased a vehicle only to find out later that it was previously wrecked and had a salvage or "rebuilt" on the title and you were not informed of this BEFORE you purchased it , call your state bureau of automotive regulation and if it was a liscensed dealer you WILL get your money back and if it was a private sale it will require a little more paper work but the result will be the same. States laws may differ but most have this. Also this disclosure has to be in writing on a salvage vehicle disclosure form if it was a dealer.
