Your reference to the coal industry dumping near streams might be a different matter from the coal ash that was recently released in Eastern Tennessee. I haven't heard anything about relaxed requirements for the the coal industry's dumping requirements, however, I have read about the coal ash that was released from a retention pond outside of a TVA owned coal fired electric generating plant.
TVA has 11 coal fired electric generating plants. They have been in place for many, many years. Each of them has a retention area where the coal ash by-product of the generation process is dumped. The ash is dried out there and eventually is removed for use in road building. The retention ponds are earthen banked. In this case, one area of one of the earthen dams broke, thus releasing the sludge that was awaiting drying and processing.
Another similar event occured in 2000 in Kentucky at one of their plants up there.
I agree with you that the government's assessments can seldom be trusted, and although they are saying that the sludge should not be ingested, they say that the contaminates in the sludge are routinely filtered out in water treatment plants that serve the area and are therefore of no immediate threat to the populace. Who knows.
In any event, this particular problem probably pre-dates President Bush.
