The reason they didn't arrest her on the spot is if she was taken into custody the county (or city) is responcible for her medical bills while in their custody. Look for her to be "processed" when she's released from the hospital.
Insurance company will pay but she'll either be dropped or the rates will go up high enough that she'll pay them back several times over.
You can get a lawyer, but if they have her dead to rights all you do is pay them a bunch of money to do little more than shuffle paper.
