No matter what he did, no matter what the nationality of his parents, no matter what his religion...he was born in Virginia, and that makes him a native-born US citizen. As a US citizen, he has the same constitutional rights an any other citizen...including you.
So that means he cannot be subject to "cruel and unusual punishment", nor can he be deprived of the same rights accorded to any other citizen accused of a crime. That's what sets America apart, and that's why we are envied to the point of hate by despots around the world.
If we descend to the level of third-world countries, where our constitution is rendered meaningless...then the folks who pray to their god [small "g"] for our downfall will have been answered, and the country that our fathers and grandfathers fought to preserve will be only a distant memory. Because when only "certain" citizens have rights, and we decide whose rights to enforce by what church they go to, we will have completely destroyed what those patriots built some 233 years ago.
