My brother and I were following an old man driving a Suburban. As we reached city limits the highway turned into a 4 lane. He wondered over to the right lane and we started to pass him. He turns his left blinker on and turns left from the right lane. My brother locked up the brakes and hit him in the rear quarter panel. The state trooper ticketed my brother for improper lane change for some reason. Upon review of the accident photos the old man's insurance paid for the damage to both vehicles even though the State Trooper defied all logic and physical evidence and wrote my brother the ticket.
But in this case it sounds like he needs to get a lawyer and force the insurance company to pay. Even if it is the other driver's fault if he doesn't have insurance the daughter is still stuck with her deductable. You can sue him for the loss but you would be further ahead and more rewarding to just kick his arse. Bums like that don't pay their bills.
