The insurance can have its point of view but at least in this state they are no better than anyone else.
In the case you stated. Allstate did not pay on their own. They went to COURT and won. Why they won may might be a whole differant ball of wax but at least they won in court.
The same holds true for police. My son was in a head on accident. Cop said it was his fault. We got our car fixed by our insurance under collision. We then went to court and was able to prove from accident pictures the other person crossed into my sons lane. I was refunded my deductable and my insurance in turn sued the other insurance for their out of pocket cost.
That is why we have courts. To settle things like this. But a insurance company can not just pay because they see it a differant way. They have to prove the officer was wrong in court.
