Filing a complaint with the a.g. may make you feel better but you are still going to have to prove your case. If your objective is to 'make yourself feel better' or make him 'pay for his crime' then you will probably do better swearing out a criminal complaint in the jurisdiction where the event occurred, if what he did crosses the line into criminal fraud. If your objective is to get your money back then a civil suit would appear to me to be the better course of action. In either case the actual facts are less of an issue than the provable facts. Proving a case with a used machine sold as is or with verbal assurances is notoriously difficult. Not to mention swearing out a criminal complaint or logging a complaint in a public forum like this one that is not provable in a legal sense opens you up to potential liability.
I cant think of anything much worse than buying something as is with no written representation of warranty. Not having proof that anything was intentionally covered up, or at least proof beyond a reasonable doubt for a criminal complaint or preponderance of evidence in a civil complaint. Then being the victim of a counter suit for slander and losing. That way you end up with not only a bad transmission but a legal bill and a judgement.
I certainly dont know what the facts or proofs are in this case; just trying to be the devils advocate. Its easy to see the facts as you see them but when one gets mad its easy to open up a whole can of worms that 5 years from now one wishes would just go away.
