I've always checked mine cold, before I start it. Figure that's the sensible way, as you aren't that interested in oil level after you shut it down. As far as the filter draining, I can't say what is right, but the operators manual says to drain the oil filter before taking the housing off to change it, so I would guess it normally should have oil in the filter, and it should not drain back to the oil pan.
