barnE, #1, is the berm on your property? If so! tell him to go fly a kite in a lighting storm. 10 yrs is the usual statute of limitations and you have had the berm for 18. #2, did the old ASCS or Soil Conservation Service (SCS) make any recommendation to do this sort of work to protect your property before you did the work.any documentations will help your stand. #3, he bought the property as is from the seller if there was a problem with flood plane issues that should have come out prior to his closing. #4, you could offer to by that 1.5 acres to make a small trap pasture.Only if that trap pasture butted up to my pens and could be tied in with the existing ones with just a little fence work. Sounds like he didn't do his homework on the place before he put pen to paper and signed his his name to the new deed. Sounds like he was Speculating on the land for a future use, not his own. Only after did he discover HIS Screw up! Here in Texas....H#LL would Freeze over before I would doze that berm down. Most especially if it is on my land!!!!!!!!!! barnE,Hope this helps! Later, John A.
