As a Country lawyer, I get a lot of these and other boundary dispute questions and my best professional legal advice must be CONSULT A LOCAL REAL ESTATE ATTORNEY and dont hang your hat on lay or even professional opinions posted here unless and until all the facts are known and a research of BOTH common and statutory law is conducted.
One Common Law which may come into play is the Doctrine of Adverse Posession while some states may have codified such.
In some jurisdictions laws of EQUITY may also come in to play. If an innocent party with "clean hands" erects a home and it turns out it encroaches slightly on anothers property, a Court of Equity may NOT for sure order the house (or a part) be torn down and might even order the boundary be re set but will still, or course, order the land whose boundary was judicially relocated be compensated.
What I'm saying as an Attorney is such cases are fact sensitive and equities can play a big part in the Courts decision REGARDLESS what ones lay or professional opinions may be.
The laws of Adverse Posession and Equity and Unjust Enrichment are way more complex then can be answered here by myself or anyone until the local laws are researched and all facts are know AND ITS STILL THEN UP TO A JUDGE so don't bet the farm on the outcome .....
