Makes good sense to me, especially on smaller jobs. If he can't front $400 for the trees, and you still want this guy to do the work for you, he orders them cash on delivery, YOU take delivery of the trees, YOU pay for them. Then at least you have the trees. Only pay him the money for the labor to plant them, if and when he plants them.
You could probably take him to small claims court, but only if you have something in writing. If you've got nothing in writing, you're up the creek. Consider it a lesson learned and move on.
Your wife completely blew it when she sent the text demanding payment with "interest."
