I will only give one piece of advice here, and that is NOT to sue anyone and do everything possible to keep from being sued. I have been sued three times in my life.
First was a guy who ignored the red lights and siren and sideswiped me when I was going into the fire department on a run. He lost in small claims.
Second was a builder I contracted to build the house I am sitting in now. Huge cost overruns. Took all the draws on the loan and went to Florida. Got into trouble with his subcontractors, most of which I had already paid, so decided to come back to MI and sue me. He lost, but my attorney fees were about $5000.
Third was end of 2015. Combine blew an engine. Sitting outside, 20 miles from home in a field. Decided I would pay a crane to remove engine and have a local guy diagnose the problem. He did so and gave me three options for repair in writing. I rejected all of them because the combine was not valuable enough to justify the cost. Told him to put it back together and bill me for the diagnostic. He took this to mean "do the most expensive repair". I negotiated a settlement and paid the crane to come back. The guy then refused to honor our agreement. Two more settlements made/not honored. Kept trying to get payments while I kept trying to get a settlement on paper. He then sued me for the full amount INCLUDING the amounts I paid the crane operator AND cost of parts he charged on my account at the dealership without authorization. His attorney admitted he had done wrong...but tough luck. My attorney said, and I quote..."I can take this to court, and you have a good position, but it will cost $12-15,000 and no guarantees." So I paid the bill.
In short...stay away from courts and lawsuits. Stop calling the legal guy an attorney. Call him "counselor" and use him as such.
