Landowner had zero proof to show LEO that the deer stand was 'in fact' on his property to begin with. The only thing the LEO can go on is real evidence. Not he said, he said type stuff.
Landowner WAS in possession of property that belonged to the Hunter. It is not up to the LEO to be the judge, all he can do is use good reasoning and look at the facts/evidence.
Evidence: Landowner has possession of hunters property in his garage. Landowner can't prove how he aquired the Deer Stand (no bill of sale). Identifying markings on deer stand show Hunter owns deer stand.
LEO conclusion: Landowner is PROBABLY telling the truth but, there is no conclusive evidence to substantiate it. Actual evidence shows that the Landowner is in possession of property that belongs to the Hunter.
I agree that the Landowner is protecting his land and has a right to do so. You just need to be careful about how you go about it.
