Law aside, do you think you got a bargain on the machine? If so, and the machine is in otherwise good condition, could the patch be redone by a good welder? Lot's of stuff out there running well with patched cases. I'd try to get something back out of the seller though, even if it is just to cover the cost of making a proper repair plus time lost.
