I usually side with the truck driver until I know the whole story because sh*t happens. Many a truck driver has veered to miss some one only to lose control and cause a worse accident. For example... A farmer loses control of his tractor and runs his tractor off in a ditch and no one says anything. A truck driver does the same thing and he is now facing 25 to life for homicide. I KNOW the farmer did not kill any one but you have to know all the facts not just what the paper said. BUT Who ever gave him the drivers license will most likely be brought up on charges also. Since he is a tractor trailer driver he must have a CDL unless he works for a farm or such. To get a CDL you have to meet the guidelines in Part 391 General qualifications of drivers. In 391.11(b)(2) it says you need to be able to speak and read english. This is so you can read warning signs posted on the highway such as Workers Ahead... Here is a Link to the rule.
