Craig made the decision to quit. the company accepted the signed paper work that stated that Craig was quiting. Under the contract we bargained with the company that covers about 900 members of our local union,
"8.061 An employee shall lose all his seniority, shall be removed from the seniority list, and shall cease to be an employee if: 8.0611 He quits."
In this case the union didnt think that it should turn its back on the many union members that had less senioity than Craig. The Union told the company that they (the company) were exclusivily in control of hiring and the union had NO problem with the company hiring Craig back. Craig didn't want to start at the bottom of the seniority list so he appealed to the company. The company filed a grievance against the union. The Union made an offer to settel the grievance with these terms,
the company bring Craig back with a loss of 1 day of seniority for each day that had passed since his quiting AND from that point on, every member of the local will have a 2 week window to change their mind after quiting.
The company did not accept these terms. the 3rd step hearing of the grievance was held, and the Union maintained that the facts were that Craig had quit and the contract language was clear that he had lost his seniority, and reiterated that the company could hire Craig back when ever they wanted to. The union acted responsibly on behalf of the whole Local union Body by upholding the collective bargaining agreement. Craig needs to accept responsibility for making the decision to Quit.
