Sorry it took me so long to get back. Your example of the long pole and someone walking into it- no, that would not fail under the V+T. Not in the way your terming it. As long as it was flagged it wouldn't be a V+T violation in the sense you want it to. That might fall under a section of Penal Law, maybe the negligence would be more appropriate in a Reckless Endangerment charge, but would not fall under the V+T. You'd get laughed out of the DA's office trying to do that.
Now, take the same pole and have a car back into it- yes, then you'd a have a V+T case. Or just going down the road with that pole sticking out and not flagged, that would be V+T. But negligence doesn't play into it.
A parked car is still a motor vehicle. A trailer is vehicle in the sense you're trying to get to. Motor Vehicles are self propelled. A trailer is the most common "vehicle" on the road. A horse drawn buggy can be a vehicle, although there was talk of creating a special category for them at one point.
