Cooter there is many FEDERAL employment laws that tie your hands abut what you learn about employees non work activities. PERIOD. I do not like cheaters but he can get into trouble publishing this affair. The one is a commissioner that would be OK legality but the other is a county employee. There he could very well be in trouble.
I do not like the fact that this is on shaky ground. Look at how all the special classes have special protection these days. Cheater fall under that same protection.
A local fellow had a moral turpitude clause in his employment contracts. He had two employees that had a non work affair. He fired both of them. He was sued by both and he lost big time. It cost him over $250K when the dust settled.
When I was on the school board we had several teachers over the years that had affairs with other teachers. Unless they where caught red handed on school grounds you could not do a darn thing. We tried on the one and the Teacher's union tied us up in court for over a year. The school board lost.
So I am talking from the been there done that school. IF he blows his mouth about the affair that he learned about in his commissioner dutied he CAN be in trouble PERSONALLY!!!.
