OT He stole my trailer, an I'm the crook?

My buddy Tim called while ago an asked me for some advice. His two car trailer was stolen today. His first call went to the cops. A county deputy responded and took a report. When the deputy opined, "I don't think you'll ever see it again." Tim told him that the trailer had a GPS tracker on it, and if the theif hooked up and activated the trailer lights the company that sold him the tracker would, for a fee, trace the trailer's movements and supply an address on where it was. The tracker had been installed as a monitoring devise and never got removed. The deputy told him that if he had the devise activated and used it to track down the theif then A: any evidence obtained in this manner would not be admissable in court and would in fact insure that this thug got off scott free; and B: Tim would be in violation of Alabama's "Anti-stalking Law" and subject to penalties greater than those for stealing the trailer. WHAT IS WRONG WITH THIS PICTURE? I told him if he wants the trailer back to turn on the tracker, and give me a call. Then if any problems arise from my solution to deney all knowledge, and claim that the trailer was back because some body must have borrowed it and failed to mention it.
